How Employers Can Create More Empathy with Compliance
Leverage the latest transparency rulings to drive employee engagement
The recent healthcare legislation opens up more opportunities for employers to embed empathetic benefits education into their plan designs. Marcy Klipfel, Businessolver’s Chief Engagement Officer, wrote an article in Forbes HR Council highlighting how employers can take advantage of the Transparency in Coverage rule and No Surprises Act to improve employee benefits literacy with equitable engagement strategies.
What’s New in Compliance?
Dependent care non-discrimination deadline approaching
If your plan failed the dependent care non-discrimination (NDT) test, you have until Dec. 31 to make corrections for the 2022 tax year. Employers are encouraged to perform their NDT testing as early as possible in their plan year (we recommend Q2) to give them plenty of runway to make corrections and adjustments as necessary.
IRS extends relief for the “family glitch” for exchange coverage
Calendar year cafeteria plans are now eligible for the premium tax credit under the IRS Notice 2022-41 extension. The IRS quietly rolled out this extension; previously only non-calendar year cafeteria plans were eligible. If plans choose to adopt this election change for existing cafeteria plans, plan participants should be informed of the change as soon as possible.
