This guidance has addressed how programs should handle paying these benefits from a tax treatment perspective, and affects payments made on or after January 1, 2025—treating 2025 as a transition year.

The Depts. Of Labor, HHS, and Treasury issued FAQs re: No Surprises Act and Gag Clause Prohibition
The Departments of Labor, Health and Human Services and Treasury (the Departments) have jointly issued new Frequently Asked Questions (FAQs) regarding implementation of certain provisions of the No Surprises Act. This includes guidance related to the Gag Clause Prohibition of the Consolidated Appropriations Act, 2021 (the CAA).
Deadline approaches for Medicare Part D Creditable/Non-Creditable Coverage reporting
Group Health Plans with a calendar-year based plan year that provide Prescription Drug coverage have until March 2, 2025, to report their Creditable/Non-Creditable disclosures to CMS (Centers for Medicare & Medicaid Services).
This reporting, due annually, is reported online via the CMS portal, and is to be completed:
- No later than 60 days from the beginning of a plan year (contract year, renewal year).
- Within 30 days after termination of a prescription drug plan.
- Within 30 days after any change in creditable coverage status.
