Reminder – PCORI reporting and fees due soon
The annual Patient-Centered Outcomes and Research Institute (PCORI) reporting and fees are due soon. These fees, due July 31 each year, have been around for a while. They were initially set to expire a few years ago but were extended for ten years and will now expire with the plan years ending on or after October 1, 2029.
Visit the IRS PCORI webpage for additional information.

New Guidance on Annual Gag Order Attestations Published
The Department of Labor issued new guidance on the annual Gag Order Attestations. These attestations affirm that the health plans and issuers have not entered into an agreement that directly or indirectly restricts the plan or issuer from making required specific data and information (including cost or quality of care data and claims information) available to certain other parties (i.e., gag clauses).
Specifically, plans and issuers may not enter into an agreement that:
- Prevents the plan or issuer from disclosing cost or quality of care information or data, and certain other information, to:
- active or eligible participants, beneficiaries, and enrollees of the plan or coverage
- the plan sponsor
- referring providers
- Prevents electronic access to de-identified claims data when requested and permitted by relevant privacy regulations.
- Restricts the plan or issuer from sharing such information with a business associate, consistent with applicable privacy regulations.
By submitting the attestation, a plan or issuer confirms that it has not entered into any agreement that violates the gag order prohibition for the attestation period.
