New state laws target pharmacy benefit manager practices

Several states have recently passed legislation that significantly changes how pharmacy benefit managers (PBMs) operate. These laws aim to improve transparency and reduce conflicts of interest in prescription drug pricing—changes that could directly affect employer-sponsored health plans.

Key updates include shifting PBM compensation models from drug price-based structures to flat service fees, requiring rebates from drug manufacturers to be passed directly to consumers, restricting PBMs from owning pharmacies, and imposing fiduciary duties in certain states. Because these laws vary by state, employers and plan sponsors should carefully review PBM-related requirements in the states where their employees live. These changes may affect plan design, vendor relationships, and overall prescription drug costs.

Federal agencies clarify Qualified Payment Amount rules under the No Surprises Act with FAQ documentation

The Departments of Health and Human Services, Labor, and Treasury have released updated guidance in the form of FAQs to help group health plans comply with provisions of the No Surprises Act (part of the Consolidated Appropriations Act, 2021) and the Affordable Care Act (ACA).

The FAQs focus on how to calculate the Qualified Payment Amount (QPA) for out-of-network services. Due to ongoing litigation in the Fifth Circuit, plans are currently expected to use a good faith, reasonable interpretation of the 2023 methodology when determining QPAs.

The guidance also outlines updated disclosure requirements to nonparticipating providers and facilities, including what must be included in QPA-related notices and when those notices must be delivered.

Group health benefits professionals should review these updates to ensure their plans remain compliant and that vendors are aligned with the latest federal expectations.

Review the FAQ document for more detail.
